1. Acceptance of these terms
By accessing or using this website you agree to these terms. If you do not agree with them, please do not use the site.
2. About us
SayNeel Technologies Private Limited is a company incorporated in India, with its registered office in Pune, Maharashtra. References to "SayNeel", "we", "us" and "our" mean that company.
3. Permitted use of this website
You may view, download and print material from this site for your own information and for evaluating whether to engage us. You must not:
- Use the site for any unlawful purpose, or in a way that breaches any applicable law or regulation;
- Attempt to gain unauthorised access to the site, its server or any connected system;
- Introduce malicious code, or attempt to interfere with the site's operation or availability;
- Scrape, harvest or systematically extract content or contact details, including for unsolicited marketing;
- Reproduce, republish or redistribute substantial parts of the site's content commercially without our written permission;
- Misrepresent your identity or your affiliation with any person or organisation.
4. Intellectual property in this website
All content on this website — text, design, graphics, layout, code, logos and the names "SayNeel" and "BalSaathi" — is owned by or licensed to SayNeel and is protected by intellectual property law. Nothing on this site grants you any licence to use our trade marks or branding.
5. Accuracy of website content
We take care to keep this site accurate and current, but content is provided for general information. Descriptions of services, capabilities and products may change. Nothing on this site is an offer capable of acceptance, and nothing forms a contract by itself.
Where this site shows sample or placeholder content — for example testimonials marked as samples, or illustrative role listings — that content is labelled as such and must not be relied on as a statement of fact.
6. Services and separate agreements
Services are provided under a separate written agreement covering scope, deliverables, timelines, fees, acceptance criteria, confidentiality, intellectual property, warranties and support. In the event of any conflict between that agreement and these terms, that agreement prevails for the services it covers.
Estimates given before a signed agreement are indicative, based on the information available at the time, and are not binding until confirmed in a proposal that both parties accept.
7. Ownership of work we deliver
Our standard position, confirmed in each engagement agreement, is:
- On full payment, intellectual property in the custom software, designs and documentation created specifically for your project transfers to you;
- We retain ownership of our pre-existing tools, frameworks and internal libraries, and grant you a perpetual, non-exclusive licence to use them within the delivered system;
- Third-party and open-source components remain subject to their own licences, which we disclose to you;
- We may describe the general nature of the work in our portfolio only with your written permission, and we will not identify you or publish figures without it.
8. Product terms, including BalSaathi
Products published by SayNeel, including BalSaathi, are governed by their own end-user terms and privacy notice presented within the product. Where those terms differ from these, the product terms apply to that product.
9. No medical or professional advice
This website, and any health-related content within our products, is provided for information and education. It does not constitute medical advice, diagnosis or treatment, and it does not replace consultation with a qualified healthcare professional.
BalSaathi does not diagnose. It records measurements, interprets them against published growth standards, provides general guidance and, where appropriate, recommends that a qualified professional be consulted. Clinical decisions remain the responsibility of a qualified clinician. If you have a medical concern about yourself or a child, seek professional care without delay. In an emergency, contact emergency services immediately.
Similarly, nothing on this site constitutes legal, financial or regulatory advice.
10. Third-party links and services
This site may link to third-party websites and services. We do not control them, do not endorse their content, and are not responsible for their availability, accuracy or privacy practices. Your use of a third-party site is governed by that site's own terms.
11. Disclaimer of warranties
To the fullest extent permitted by law, this website is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
This clause applies to this website. Warranties for services we deliver are set out in the applicable engagement agreement.
12. Limitation of liability
To the fullest extent permitted by law, SayNeel shall not be liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data, business or goodwill, arising out of or in connection with your use of this website.
Our total aggregate liability arising from your use of this website shall not exceed one thousand Indian rupees (₹1,000). Liability arising from a services engagement is governed by the limitation of liability clause in the relevant agreement.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
13. Indemnity
You agree to indemnify and hold SayNeel harmless from any claim, loss, liability or expense (including reasonable legal costs) arising from your breach of these terms or your unlawful use of this website.
14. Privacy
Our handling of personal data is described in our Privacy policy, and our use of cookies and local storage in our Cookie policy. Both form part of these terms.
15. Changes to these terms
We may update these terms from time to time. The revision date at the top of this page indicates when they last changed. Continued use of the site after a change constitutes acceptance of the revised terms.
16. Governing law and jurisdiction
These terms are governed by the laws of India. The courts at Pune, Maharashtra shall have exclusive jurisdiction over any dispute arising from them, subject to any dispute-resolution provisions in a separate engagement agreement.
